TO CONSIDER SPECIAL EXCEPTION APPLICATION TLSE-2017-0004,
FEDERAL REALTY INVESTMENT TRUST
Pursuant to Sections 15.2-1427, 15.2-2204, 15.2-2205 and 15.2-2285 of the Code of Virginia, 1950, as amended, the Leesburg Planning Commission will hold a public hearing on Thursday, March 15, 2017 at 7:00 p.m. in the Town Council Chambers, 25 West Market Street, Leesburg, Virginia 20176, to consider Special Exception application TLSE-2017-0004, Federal Realty Investment Trust.
The subject property consists of two parcels that collectively comprise 0.60 acres owned by Federal Realty Investment Trust, and is located at 526 East Market Street. The property is zoned CD-CC, Crescent Design District – Commercial Corridor, and is further described as Loudoun County Parcel Identification Numbers (PIN) 188-15-9166 and a portion of 188-25-9123.
Special Exception Application TLSE-2017-0004 is a request by Federal Realty Investment Trust for a Special Exception to allow an approximately 2,500 square foot eating establishment with drive through to be constructed after demolition of an existing structure on the site. In addition, the Applicant is requesting three modifications per Town of Leesburg Zoning Ordinance (TLZO) Section 7.10.12.B as follows:
- Modification of TLZO Sec. 7.10.6.J.2 Building Type Specifications; Drive-through Window Building Specifications, Canopy. Request to not provide a pitched roof over a drive through lane.
- Modification of TLZO Sec. 7.10.6.J.2 Building Type Specifications; Drive-through Window Building Design Specifications, Windows. Request to provide more than 50% of the Secondary Front Façade (southeast elevation) window area as faux window panels.
- Modification of TLZO Sec. 7.10.6.J.5 Building Type Specifications; Drive-through Window Building Design Specifications, Height. Request to allow a minimum building height of 25 feet with a flat roof and not the required pitched roof.
